1.1 These general terms and conditions apply to all offers, orders, and agreements between dr. Wiggly Eye (hereinafter: “seller”) and the buyer, including digital products such as STL and Bambu Studio files.
1.2 By placing an order, the buyer agrees to these general terms and conditions.
2.1 All offers by the seller are without obligation and while supplies last.
2.2 An agreement is concluded once the buyer places an order and the seller accepts it by delivering or providing the download.
3.1 The stated prices include VAT and exclude any shipping costs, unless stated otherwise.
3.2 Payment can be made via the payment methods offered on the website.
3.3 Digital products are only made available after full payment has been received.
4.1 Physical products are delivered to the address provided by the buyer within the indicated delivery time.
4.2 Digital products are made available via a download link received by the buyer after payment.
5.1 For physical products, the statutory 14-day withdrawal right applies.
5.2 For digital products, the withdrawal right expires once the buyer begins the delivery by downloading the files.
5.3 By purchasing digital products, the buyer acknowledges this and expressly waives the right of withdrawal once the download starts.
5.4 Returns of physical products must be unused and undamaged.
6.1 Digital 3D files are subject to a license that governs their use. This license is provided with the product and must be accepted.
6.2 Use of digital files is only permitted within the scope of the granted license (personal or commercial).
All designs, images, 3D models, cartoon characters, logos, and other creative expressions on the website and in the digital files of dr. Wiggly Eye are protected by copyright and, where applicable, trademarks.
It is not permitted to use these works without prior written consent from dr. Wiggly Eye to:
copy
distribute
publish
modify
commercially exploit
Purchasing physical products or digital files does not grant ownership of the creative designs themselves; you only receive the right to use as described in the relevant license or in these General Terms and Conditions.
8.1 The seller is not liable for damage caused by the use of physical or digital products, unless intentional or gross negligence applies.
8.2 For digital files, the seller is not liable for damage to equipment, materials, or consequential damage.
9.1 Personal data is processed in accordance with the privacy statement available on the website.
10.1 All agreements are governed by Dutch law.
10.2 Disputes will be submitted to the competent court in the Zeeland-West-Brabant district, location Breda.
